CHARTER BOOKINGS, DEPOSITS, CANCELLATIONS, AND NO-REFUND POLICY

Effective Date: January 2025

By booking a charter, submitting a deposit, or completing any payment with BiscayneClub (Company), you (Client, Renter, or Cardholder) explicitly acknowledge, understand, and unconditionally agree to the following binding terms and conditions. These policies are strictly enforced to protect our vessel availability, crew scheduling, and operational integrity.

1. Deposit Requirements and Final Payment

1.1 Non-Refundable Deposit: All bookings require an upfront deposit (percentage or fixed amount as specified at checkout). Once a deposit is paid, it is 100% NON-REFUNDABLE under any and all circumstances. Payment of the deposit acts as an express, binding confirmation of the charter agreement.

1.2 Final Balances: All remaining balances must be paid in full prior to boarding or as outlined in your specific booking invoice. Failure to pay the remaining balance does not void this agreement or entitle the Client to a refund of any previously paid funds.

2. Strict No-Refund and No-Cancellation Policy

2.1 General No-Refund Policy: All sales, deposits, and charter fees are strictly FINAL AND NON-REFUNDABLE. Once a reservation is secured, the vessel, captain, crew, and preparation time are exclusively reserved for the Client.

2.2 Weather and Force Majeure: In the event of inclement weather, safety hazards, or governmental restrictions as determined solely by the Captain or Company, charters may be rescheduled at the Company’s discretion. No refunds will be issued for weather-related postponements, rescheduling, or failure of the Client to attend.

2.3 Client No-Shows and Late Arrivals: If the Client fails to arrive, arrives late, or is unable to attend the charter for any reason (including personal emergencies, travel delays, medical issues, or failure to meet boarding requirements), the charter time will not be extended, and no refunds or credits will be provided.

3. Strict Time Limits for Inquiries and Disputes (90-Day Absolute Cutoff)

3.1 In accordance with commercial operating standards, no billing adjustments, charge disputes, or claims of any kind will be entertained, recognized, or accepted after ninety (90) days from the initial booking or payment date, regardless of whether the charter took place or whether the Client was able to attend.

4. Waiver of Chargebacks and Payment Dispute Agreement

4.1 Express Agreement Against Chargebacks: By submitting payment via credit card, debit card, or any other electronic payment method, the Client expressly agrees that they understand and agree to this No-Refund Policy. The Client explicitly waives any right to initiate a chargeback, bank dispute, or payment reversal with their financial institution for reasons including, but not limited to: dissatisfaction with services, weather conditions, personal schedule conflicts, failure to attend, or buyer’s remorse, once a deposit or payment has been processed.

4.2 Evidence in Disputes: In the event that a chargeback or payment dispute is fraudulently or improperly initiated by the Client through their bank or credit card issuer, the Company reserves the right to submit this Agreement, IP logs, digital signatures, signed booking forms, GPS tracking logs, photographic/video evidence of service delivery (including boarding logs and vessel occupancy records), and electronic communication logs to the payment processor, merchant bank, and card network as definitive proof of authorization and service fulfillment.

4.3 Recovery of Dispute Costs: If a chargeback is initiated and subsequently ruled in favor of the Company, or if the dispute is found to be in violation of this signed agreement, the Client agrees to be held financially liable for any and all chargeback fees, administrative costs, legal fees, and collection expenses incurred by the Company in defending the transaction.

5. Acknowledgement and Electronic Acceptance

By checking the box to agree to our Terms of Service during checkout, signing our digital charter agreement, or submitting payment for any deposit or invoice, you certify that you have read, understood, and unconditionally agreed to all terms outlined above, and that you waive any legal or financial right to dispute validly processed charges.
